General Description

Performs complex (journey-level) legal research and analysis work. Work involves examining and preparing legal documents for prosecution of cases involving violations of the laws and rules pertaining to the practice of pharmacy at Informal Conferences and, if necessary, at the State Office of Administrative Hearings. Work also includes conducting research, assisting attorneys, and evaluating documents for making recommendations to attorneys.

Works under general supervision of the General Counsel and/or other Division attorneys, with moderate latitude for the use of initiative and independent judgment.

Essential Duties and Responsibilities

  • Reviews cases referred to the Legal Division for legal sufficiency.
  • Drafts Preliminary Notice Letters, Agreed Board Orders, and other legal documents relating to informal disposition ofadministrative cases in timely and accurate manner.
  • Presents cases at informal conferences, which gives licensees an opportunity to show compliance with the laws and rules governing the practice of pharmacy.
  • Assists the agency's attorneys in advising and providing legal opinions to Board and agency staff on legal matters related tolicensee disciplinary action.
  • Interacts with appropriate local, state and federal prosecutors, legal divisions and enforcement agencies involved in theinvestigation or prosecution of licensees.
  • Researches legal issues and prepares briefs and memos under the direction of the agency's attorneys.
  • Researches points of law involved in hearings to determine the validity and completeness of cases cited.
  • May assist attorneys in preparing cases for litigation and in preparing investigations.
  • May draft memoranda and administrative rules for the Texas Register.
  • Determines work priorities and schedules time accordingly.
  • Complies with all agency policies, including regular attendance.
  • Performs related duties as assigned.

Knowledge, Skills, and Abilities: Knowledge of legal principles, practices, and proceedings; and of agency laws, regulations, and rules. Knowledge of administrative law preferred. Skill in using logic and reasoning to identify the strengths and weaknesses of alternative solutions, conclusions, or approaches to problems; and in the use of a computer and applicable software. Ability to prepare legal documents; to interpret and apply laws, rules, and regulations; to conduct research; to summarize findings; and to communicate effectively. Education and Experience Requirements: Experience in legal work required. Must be enrolled in or have graduated from an accredited law school with an LLB or JD degree. Previous experience at the Texas State Board of Pharmacy (TSBP) or another Texas state agency is highly preferred. Experience in a pharmacy licensed by TSBP is preferred.
